Title: Wittnesses to Philip Livingston's last will and testament

Banyar declares that Cornelius Clopper, John Richard, and John Clopper appeared before him and swore that they saw Philip Livingston sign his will while he was still alive and of sound mind. They therefore declare that the will dated the 1 July 1748 is the true will of Philip Livingston. This is followed by another statement dated the 5 July 1748 in which Banyar declares that 5 executors of the will of Philip Livingston appeared before him and swore to execute and perform the said will.

Title: Last will and testament of Philip Livingston

Philip Livingston bequeathed unto his oldest son Robert Junior all lands, tenements, and mills on the Manor, a house in Albany, and his enslaved people and livestock. He notes, however, that if he should die between February and September, Robert is to allow his mother (Catharine Livingston) and the younger children to use to mill to prepare all their wheat and cornell. To his wife, Philip leaves the remainder of his estate, and entrusts her with the education and welfare of their two daughters. Douglas writes that he sold some shroud to Philip's father and sister, and he suggests that Philip sell their blankets and duffel to the Commissioners in charge of the upcoming expedition to Canada. He also notifies Philip of his decision to accompany Samuel Vetch on the expedition, and orders all of his goods and property to be remitted to his brother James Douglas if he dies. Robert, Jr. authorizes John Wigram to enter the house of the late Andries Bartle and distrain goods to the amount of 48 pounds for overdue rent. He then states that if payment is not made by the 1st of January next, Wigram is to appraise and sell the goods, and then to dispose of the money in a specified manner.

Estate inventory taken 17 February 1795 and filed on 13 March 1800. Document signed by Seth Marvin and John W. Tuthill in 1795, and by Samuel Strong and Richard Woodhull in 1800. No place of creation, but Woodhull was living in New Cornwall, Orange County, New York in 1790. Lists the items found on his farm. Includes: 25 oxen, 13 cows, 90 sheep, 10 hogs, and farm utensils worth 100 pounds. Also has 18 slaves. The document states that Margaret Livingston, the executrix of the late Peter R. Livingston, agrees with Robert [T.] Livingston to uphold an agreement previously made between Peter and Robert in which the latter is entitled to any and all rents, issues, and profits belonging to the former, including those accrued after Peter R.'s death.
