Worden commanded the USS "Monitor" against the Confederate vessel "Virginia" (originally named "Merrimack") in first battle of ironclad ships in 1862.

The defendant, George Saxby, was ordered to pay a sum to the complainant, William Waties, including two thirds of the cost of the lawsuit.
