Docket, signed by Sheriff Fitzgerald, indicates the letter was returned on 4 October 1844 not executed because Capeland was not found in the county.

Griffin on the second page indicates that the sale was recorded in the Liberty County records on 2 May 1841.

Title: [Certificate of Mary Smith's right to Texas land and her transfer of that land to A.J. Brightwell]

Certified, on 7 August 1843, that Mary Smith, a widow who came to Texas in August 1842, was entitled to a conditional grant of 640 acres in San Augustine County, Texas (accordance with a Texas congressional act passed 15 January 1842). Beneath it is a transfer of Smith's certificate to A.J. Brightwell dated 6 March 1850 and a attestation to the transfer by the clerk, P.M. Graham dated 18 March 1850. At the bottom of page two, George W. Smyth, the commissioner of the General Land Office, certified on 6 August 1850 that this document was a true copy.
