Pickering argues that the proposed twelfth amendment, which would reform the Electoral College, would help realize the intent of the framers and give the Constitution "stability and duration." Referring to the contentious, drawn-out presidential election of 1800, he asks who would have answered for the consequences, if a president had not been elected by March 4th, and the Constitution had thus run out. He notes that the framers expected amendments, and points out that "it is a well known fact that the amendments already incorporated into the constitution have greatly increased its friends."…

Says that no matter how the Senate rules he knows the measures he took were necessary and that "I acted in the defence of New Orleans with the purest principles of a patriot." Relates his poor health and confidence that Van Buren will be the Democratic Nominee for President. Hancock argues that the bill making Sunday a day of Sabbath in Congress was improperly passed. The Constitution provided a set amount of time to rebuke a bill's passing, and others in Congress accused Hancock of sending his letter of rebuttal too late. However, Hancock asserts that real time and the time that the House had been using were very different things.

I found a prosecution going on against Duane for an offense against the Senate, founded on the Sedition act. I affirm that act to be no law, because in opposition to the Constitution; and I shall treat it as a nullity whenever it comes in the way of my functions.."
