Though the winner of the election was not official until December 2nd, enough states had held their elections for Jackson to be confident of victory.

He appealed to the Second Circuit Court of Appeals on 2 February 1924 where his case was still pending. Coolidge commuted his sentence to one day in the custody of a U.S. Marshal; no reason given.
