Cherokee Nation v. Georgia
The Supreme Court declined to rule in the case of Cherokee Nation v. Georgia on the grounds that “an Indian tribe or nation within the United States is not a foreign state in the sense of the constitution, and cannot maintain an action in the courts of the United States.”

Historical Background
In 1830, under President Andrew Jackson, Congress passed the Indian Removal Act directing the executive branch to negotiate for Indian lands. The act set the tone for President Jackson in dealing with Indian affairs. The removal of the Cherokee Nation from the state of Georgia started under Jackson and outlasted his term in office.
